Terms of service

These terms are an agreement between MadFish Solutions, LLC (“MadFish”, “we”) and the business that subscribes to Iron Register (“you”, the “dealer”). By creating an account or using the service you agree to them.

1. The service

Iron Register is point-of-sale and recordkeeping software for firearms retailers, delivered as a subscription on a server provisioned for your business. We will run it, keep it patched, back it up, and provide the features described on our website for the tier you subscribe to. We may improve or change features over time; we will not remove a capability your compliance records depend on without notice and an export path.

2. Your responsibilities

• You are the federal firearms licensee. Compliance with the Gun Control Act, ATF regulations, and state and local law is your responsibility. Iron Register helps you keep the required records; it does not make the records correct or complete for you.
• Iron Register does not transmit background checks. You run NICS or state point-of-contact checks yourself and record the result. You must not transfer a firearm on the basis of anything the software displays without a valid check result.
• You are responsible for the accuracy of the data you and your staff enter, for keeping your credentials and cashier PINs confidential, and for the actions of anyone you give access to.
• You will use the service only for lawful business purposes and will not attempt to access other dealers’ systems, reverse engineer the service, or resell it.

3. Subscription, billing and cancellation

• Plans are billed monthly in advance, or annually in advance at the discounted rate shown at purchase. There are no setup fees, no minimum term and no per-transaction fees.
• You may cancel at any time from the billing settings or by email. Monthly plans end at the close of the paid month; annual plans end at the close of the paid year and are not refunded for the unused portion except where the law requires.
• Tier limits (locations and registers) are enforced by the software. Moving up takes effect immediately and is prorated; moving down takes effect at the next renewal.
• If a payment fails we will retry and notify you. After 14 days unpaid the service becomes read-only; after 30 days it is suspended. Your data is kept for a further 30 days so you can export it.

4. Your data

• You own the data you put into Iron Register. We process it only to provide the service, as described in our Privacy policy.
• You can export your bound book, Form 4473 records, sales, inventory and customers at any time in standard formats, without charge.
• After termination we keep your data for 30 days for export and then delete it, except where a record is required to be kept by law or is needed to resolve a dispute. Bound book and 4473 records that must be retained under 27 CFR 478 will be provided to you in a form suitable for retention before deletion.

5. Availability and support

We work to keep the service available around the clock and will schedule maintenance outside normal store hours where we can. The register keeps working for accessory sales during a network outage and syncs when connectivity returns. Support is by email and in-app chat and is answered by the people who build the product, normally within one business day. We do not offer a guaranteed response time or uptime percentage.

6. Third-party services and hardware

Integrations with BigCommerce, Flxpoint, ShipStation, payment processors and other services are governed by those providers’ terms. We are not responsible for their availability or for changes they make. Any hardware you buy, whether recommended by us or not, is sold and warranted by its manufacturer or reseller, not by MadFish.

7. Warranty and liability

The service is provided “as is”. To the fullest extent permitted by law we disclaim implied warranties, and our total liability to you for any claim arising from the service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential losses, including regulatory penalties, lost sales or lost data, except where caused by our gross negligence or willful misconduct. Nothing in these terms limits liability that cannot be limited by law.

8. Termination by us

We may suspend or end your subscription if you materially breach these terms, if your federal firearms license is revoked or surrendered, or if required by law. Except in an emergency we will give notice and an opportunity to export your data.

9. Changes to these terms

We may update these terms. We will email the account owner at least 30 days before a material change takes effect. Continuing to use the service after that date means you accept the change.

10. General

These terms are governed by the laws of the state in which MadFish Solutions, LLC is organized, without regard to conflict-of-law rules, and any dispute will be brought in the courts of that state. If any part of these terms is unenforceable the rest remains in effect. These terms, with the Privacy policy and your order, are the whole agreement between us.
